ClubSports.live® Terms of Service

The Terms of Service ("Terms") listed below will govern your access to and use of ClubSports.live® platform, including our website, web application, club websites, and mobile application (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. Please read them carefully.

1. Services

ClubSports.live® provides a platform for sports clubs to manage their members, finances, schedules, and communications. This includes features for member management, payment collection (membership fees, match fees, etc.), expense tracking, match scheduling, player availability tracking, and club website creation.

2. User Responsibilities

• Club Authorization: Any authorized member of a club can request to create a club on ClubSports.live®. The requesting member is responsible for providing accurate contact and financial information for the club.
• Information Accuracy: You are responsible for the accuracy of all information you provide to the Platform, including member data, club details, and financial information.
• Payment Processing: Clubs authorize ClubSports.live® to collect payments from their members. Stripe, our current payment gateway, will deduct standard payment gateway charges and payout charges. ClubSports.live will deduct platform fees from the collected amount.
• Stripe Account: Clubs are required to provide bank account details and assist ClubSports.live® in setting up a Stripe account (or equivalent payment gateway account) for online payment processing.
• Compliance: You agree to comply with all applicable laws and regulations in your use of the Platform, including data privacy regulations like GDPR.
• Cooperation: You agree to cooperate with ClubSports.live and provide any necessary information to service providers or government authorities where ClubSports.live® operates.

3. ClubSports.live® Responsibilities

• Platform Provision: We will provide and maintain the Platform, including necessary updates and support.
• Club Enrolment: ClubSports.live® reserves the right to add or remove a club to the Platform. Clubs will be added only after verification. ClubSports.live may reject club enrolment at any point if the club is found to be non-genuine. ClubSports.live reserves the right to remove or make a club inactive if the club violates these Terms.
• Payment Processing: We will facilitate online payment collection through our chosen payment gateway. We reserve the right to change our payment gateway in the future. Collected payments will be released to the club's bank account, on a monthly basis adhering to the payment gateway's policy. If no bank account is provided, the funds will be transferred to ClubSports.live®’s designated account. ClubSports.live® will deduct platform fees from the collected amount when payouts are made to the club's bank account.
• Data Security: We store member data securely in AWS RDS instances, employing standard security practices. The Platform, its contents, website, and API are protected by SSL and Amazon's web firewall.
• Communication: We will use provided email addresses for bulk emailing via a bulk email service provider, and phone numbers for app notifications via WhatsApp. We will also use Firebase for app notifications.
• App Distribution: ClubSports.live® may share club or user information with Apple and Google as the mobile app is distributed via their respective app stores.

4. Data Privacy

Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect your data. Key points include:

• Data Collection: We collect member data such as name, email, mobile number, gender, location, address, blood group, nationality, food preference, medical information (major health conditions, doctor details, emergency contacts), profile photos, and group photos. We also collect device information like IP address, device type, OS type, and device location. Club information, including contact details of club administrators/management, and financial information (bank account details) are also collected.
• Data Use: We use member data to provide the Platform's functionalities, manage members, send notifications, for internal marketing purposes, and to comply with legal obligations.
• Data Sharing: We share name and email addresses with Amazon SES for bulk emailing, phone numbers with WhatsApp for notifications, and device information with Firebase for notifications and platform management. Financial information is shared with Stripe (or our chosen payment gateway). We may share data with Apple and Google for app distribution. We do not share your data with other third parties except as required by law or with your explicit consent.
• Data Security: We maintain appropriate security measures, including AWS standard security practices, to protect your data.
• Data Retention: Data will be kept as long as needed and for auditing purposes. Even after a user account or club is deleted, minimal information may be retained for auditing and platform functionality maintenance.
• GDPR Compliance: We strive to comply with GDPR regulations in storing and handling user and club data.
• Club Website Information: Contact information (admin/committee contacts and photos) provided by the club will be displayed on the club's dedicated website.

5. Refund Policy

As our platform facilitates payments directly to the clubs, and usage of our platform is free for club users when their club is enrolled, we generally do not offer refunds for any payments made to the clubs through our platform.

Even if a club agrees to issue a refund to a user/member, clubsports.live will not process any online refunds. In such cases, the refund will be issued by the club to the user through other means or via an offline payment method. Please coordinate directly with the club regarding the refund process.

Exception for Unintended Payments: In the event that our platform, clubsports.live, inadvertently collects a payment that was not intended by the club, clubsports.live will issue a complete refund of the said payment. To initiate this process, the user must notify the clubsports.live support team with relevant details and proof of the unintended payment. Upon verification, the refund will be processed within 30 days from the date of notification.

All other payment-related inquiries, including general requests for refunds or disputes, should be directed to the specific club you made the payment to. We are unable to intervene in or process refunds on behalf of the clubs, except in the case of unintended payments as described above.

6. Cancellation Policy

Our platform offers its services free of charge to club users whose clubs are enrolled. Therefore, there is no need for users to cancel any subscriptions or services with our platform directly. If you wish to discontinue your engagement with a particular club, please manage your membership or communication preferences directly with that club, according to their own policies and procedures. 

For Clubs: Clubs enrolled on our platform can manage their presence and services according to the terms of their agreement with us. If a club wishes to terminate its enrollment, they should refer to their agreement or contact our support team for guidance.

7. Intellectual Property

All intellectual property rights in the Platform belong to Kalpak LTD and QwickSpark India Services LLP.

8. Disclaimer of Warranties

The Platform is provided "as is" without any warranties of any kind, either express or implied.

9. Limitation of Liability

We will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

10. Governing Law

These Terms will be governed by and construed in accordance with the laws of both India and the UK.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Platform.
